Brian Leyden Defies Trust, Allows Brother To Be Evicted

Ra'anana, Israel --- April 25, 2012 .... Brian Leyden, in defying the terms of the Joel Leyden Trust, has allowed Joel to be evicted from his home in Israel. All of Joel's personal possessions are now on the street.

The Trust calls for the "well-being", the "protection" and to address any "emergencies" for which Joel and his children face. That Brian Leyden allowed Joel to be evicted from his only home and for the destruction of Joel's home is nothing less than psychotic behavior, narcissistic behavior which reflects gross negligence, abuse of power as Trustee and a total absence of responsibility.

Bernard Leyden would not have wanted his son Joel to be without a home.
For his home to be destroyed.
For Joel to be suffering and separated from his children.

Spends his brother's money to prevent his brother's children

Brian Leyden lives in a multi million dollar home in Great Neck, New York yet it appears that he does all he can with his brother's money to keep his family living in poverty in Israel. 

Brian Leyden's brother has young children living in Israel and they need money for food, clothes, doctors and medicine, yet Brian Leyden prevents his brother from helping his own children.

Brian Leyden is so insensitive, so callous that he states to his brother: 

"If you want to see your children, go to Cyprus." 
Or 
"simply stay in the United States and never see your children again."

Brian Leyden's brother has not seen his young children in over a year!

JOEL LEYDEN, being duly sworn, deposes and says: 


1. I am a Citizen of Israel and have been in the United States since October of 2010.

2. My father died and left a Trust which provides that BRIAN LEYDEN, my brother be 
appointed the Trustee and to administer the Trust for the “well being and protection” of myself 
and my children. Monies were to be allocated from my Trust in the event of “emergencies”. I 
presently have three (3) children, namely, AMANDA LEYDEN, DAVID LEYDEN and LIOR 
LEYDEN, who are all residents of the State of Israel. 

13. I believe that based upon what my brother is now doing, that he is acting in bad faith.

15. I ask the Court to hold a hearing so that BRIAN LEYDEN may testify and the Court
can see for itself whether or not BRIAN LEYDEN is still acting in my best interest.


17. No prior requested for the relief has been made.
WHEREFORE, your deponent respectfully requests that the Court grant the Order To
Show Cause directing BRIAN LEYDEN to show cause, as Trustee under the Last Will and
Testament of BERNARD LEYDEN why an Order should not be made directing him to forthwith
forward the sum of $xxxxxx., in escrow, and to pay the sum of S xxxxxxx
and for such other and further
relief as this Court may deem just and proper.

A New York Law firm in New York was retained by Bernard Leyden who wanted to have a Trust fund created for his son Joel Leyden.

The Trust, written by Herzfeld & Rubin, explicitly states that it was created for Joel's "well being", "protection" and for "emergencies".

Herzfeld & Rubin has taken over $80,000 in legal fees from the Trust to prevent Joel from going home to Israel, providing for his children's food, clothes and medical needs. 

Is this Joel's "protection", "well-being"?
